In a dramatic turn of events, the South African Local Government Bargaining Council has ruled in favour of the embattled expelled Municipal Manager of the Alfred Nzo District Municipality, Zamile Herbert Sikhundla, ordering his reinstatement by no later than September 10, 2025. This decision comes after nearly two years of legal wrangling following his dismissal in November 2024 over a series of serious charges, including failing to implement council resolutions and mismanaging municipal funds.
Sikhundla, found guilty of 17 charges, was expelled through a council resolution, but he immediately took legal action, claiming his dismissal was unfair. The court referred the case to the Bargaining Council, which determined that his firing was substantively unjust. The council ruled that Sikhundla should be reinstated with immediate effect, dating back to November 4, 2024. Additionally, he is entitled to six months’ back pay, totaling R730,749.72, minus statutory deductions, which the municipality must pay by September 30, 2025.
The decision has stirred a storm of controversy. Sikhundla has confirmed his intention to return to work on the prescribed date, despite the municipality’s claims that they have yet to receive the official judgment. Municipality spokesperson Luncedo Walaza has expressed uncertainty, stating they can’t comment until they see the ruling themselves. Meanwhile, local politics are adding fuel to the fire, with the ANC’s regional leadership recently urging the district to drop costly court battles, a move that has not gone down well with local officials. The issue of litigations faced by the District Municipality heightened tensions between the ANC’s provincial chairperson Oscar Mabuyane and the district’s executive mayor Vukile Mhlelembana leading to a public spat in the regional conference.
As Sikhundla prepares to take up his post again, questions remain about how the municipality will navigate the complex legal and political fallout. What will happen when he steps back into his office tomorrow? Only time will tell.
