NOXOLO PHINDELA DUMPS HER MOTHER IN MURDER TRIAL
In an unexpected turn of events, Noxolo Phindela has chosen to represent herself in a murder trial, leaving her mother, Matsideso Lechamochamo, without legal counsel. Accused number 2 in the case involving the murder of Simbongile Sihlwayi, Phindela, who is Lechamochamo’s stepdaughter, had initially been represented by defense lawyer Mathebe. However, on Wednesday, a sudden change occurred as Phindela appeared in court unwell, accompanied by a new defense advocate, E.S. Dingiswayo.
Prosecutor Advocate Luvuyo Phumullo opened the court proceedings by introducing defense lawyers, including Mr. Nyawose from Legal Aid and Advocate Dingiswayo representing Phindela. Mr. Nyawose confirmed that he no longer represented accused 1 and 2, stating that they had sought the services of Advocate Dingiswayo. In a surprising twist, Dingiswayo clarified that he was representing accused number 2 (Phindela) only, leaving Lechamochamo without legal representation.
Upon inquiry from the court about her plans for legal representation, Lechamochamo expressed disappointment, stating, “I need to speak to Noxolo because I do not understand what is happening.” The court adjourned for five minutes to allow Lechamochamo and Phindela to confer. However, after the break, it became apparent that no agreement had been reached, leading Lechamochamo to appoint Nyawose as her legal representative.
The legal drama unfolded when Phindela and Lechamochamo failed to pay legal fees to their initial lawyer, Mathebe. Subsequently, they opted for Legal Aid under Mr. V. Nyawose. Phindela, reporting sick on the trial date, sent contested medical certificates, prompting an arrest warrant. On Wednesday, she introduced Advocate Dingiswayo, leaving her mother without legal representation.
The murder and kidnapping charges involve Phindela, Lechamochamo, and three others, accused of killing Simbongile Sehlwayi, a drug seller allegedly working for them. Sehlwayi disappeared with money and drugs, leading to a violent confrontation where he was fatally beaten. The trial is scheduled to resume on February 27, 2024.
