The National Prosecuting Authority has clarified that siblings may be entitled to claim maintenance, under specific circumstances where parents are unable to provide financial support.
While parents have the primary legal duty to support their children, the NPA confirmed that this responsibility can extend to siblings if the claimant is a minor or financially dependent, and the parent is deceased, incapacitated, or unable to provide support.
“The law allows maintenance claims between siblings in instances where closer relatives cannot fulfil their duty of support. Each case is assessed on its own merits, considering both the need of the claimant and the ability of the sibling to provide support,” said the NPA in a statement.
Applications for sibling maintenance can be lodged at the nearest Maintenance Court, which will evaluate the financial capacity of the sibling and the genuine needs of the claimant before making a ruling.
This clarification comes as part of ongoing efforts by the NPA to ensure families are aware of their legal rights and obligations regarding financial support.
